Play Moehr Games is a personal arcade: I build browser games in my spare time and put them here for free. These terms are the deal between you and me when you use the site. I wrote them in plain English on purpose, because a wall of legalese helps nobody, least of all you.
The short version: play the games for free, be decent about it, and do not resell or rehost my work. These are hobby projects, so they will occasionally break. If something goes wrong, what I owe you is capped, and you paid me nothing.
Who you are agreeing with
Play Moehr Games is run by Tim Moehring, an individual based in Washington State, USA. In these terms, "I" and "my" mean Tim. "You" means the person using the site. "The site" means playmoehrgames.com and everything under it: the arcade, the reviews, the shop pages, the Beta Club, and the What's New feed.
Reach me at tim@playmoehrgames.com. That address is the front door for everything in these terms.
Using the site means you accept these terms
If you do not agree with something here, the fix is simple: do not use the site. If you keep using it after I update these terms, that counts as accepting the updated version. The date at the top moves whenever I change something.
You need to be 13 or older
The site is not built for children under 13, it is not directed to them, and I do not knowingly collect anything from them. If you are under 13, please do not use the site or send me feedback.
If you are between 13 and 18, or under whatever the age of majority is where you live, read this with a parent or guardian and use the site with their permission.
If you believe a child under 13 has sent me something, email me and I will delete it. See the Privacy Policy for the details.
What the games cost: nothing
Every game is free to play in your browser. No account, no payment, no ads, no upsell. There is nothing to buy on the arcade side of this site.
I can add, change, gate, or remove any game at any time, including one you were in the middle of. Games save progress in your own browser, so clearing your browser data wipes those saves and I have no copy to restore.
What you can do with the games
Play them, share the link, stream them, record them, put them in a video: all fine, and genuinely appreciated. Credit "Play Moehr Games" and link back when it is easy to do.
Here is what is not fine:
- Rehosting a game on another site, app store, or arcade portal
- Selling access to a game, or putting one behind someone else's paywall or ad wall
- Pulling out the art, music, code, or assets to use in your own project
- Passing any of it off as your own work
Want to do something that is not on that list? Ask me. The answer is usually yes.
Who owns what
I own the games and everything in them: the code, the pixel art, the music, the writing, the screenshots, and the site itself. Playing a game does not transfer any of that to you. Some games use open source libraries and fonts that carry their own licenses, and those licenses govern those specific pieces.
The reviews section covers games made by other people. Those games, their names, their screenshots, and their trademarks belong to their creators. I write about them as commentary and criticism, and nothing there claims otherwise.
Feedback, votes, and the stuff you type
Every game has a widget for a thumbs up or down and a short private note, capped at 500 characters. Two things to know about it.
First: if you send me a note, I can read it, act on it, quote it, and use it to make the games better, with no payment or credit owed to you. That is the whole point of the box. Notes go in, get read, and turn into changes.
Second: it is a plain text box on a hobby site, so treat it that way. Do not type your name, address, phone number, passwords, or anything sensitive into it. Do not paste someone else's private information, and do not send anything you do not have the right to share. The Privacy Policy explains exactly what happens to a note after you send it.
I can remove any submission for any reason, and I will remove anything abusive, illegal, or spammy without a conversation about it.
Beta Club
The Beta Club is invitation only. Sign-in works by magic link sent to your email, and that link is a key: anyone holding it gets in as you. Do not forward it.
Beta games are unfinished on purpose. Expect bugs, wiped saves, features that change, and games that disappear entirely. Please do not publish screenshots, videos, or details of a beta game before it goes public unless I tell you it is fine.
I can end Beta Club access at any time, and you can leave any time by emailing me.
The shop
The shop pages are a catalog of handcrafted physical games plus free build plans. There is no cart, no checkout, and no payment processor anywhere on this site. The "Order / Inquire" buttons open an email to me.
So: nothing on those pages is a binding offer to sell. Price, availability, materials, shipping, and timing are whatever you and I agree in writing over email. Until we agree, no sale exists and nothing is owed either direction.
The build plans are free to use for your own build. Building is on you: I list dimensions and materials, not safety guarantees, and a table saw does not care about my footnotes. Use the right tools, wear the right gear, and check your local rules.
Fair use of the site itself
Please do not:
- Scrape, hammer, or run automated traffic against the site or its APIs beyond ordinary play
- Try to reach internal or beta games you were not given access to, or forge a session cookie
- Stuff votes, script the feedback endpoint, or fake activity of any kind
- Probe, break, or overload anything, or use the site to host or pass along anything malicious
I run rate limits, and I will block traffic that trips them.
Other people's services
The site runs on infrastructure I do not own: hosting, a database, analytics, and email. Those providers are named in the Privacy Policy, and their own terms apply to their own services.
Links out to other sites are not endorsements. I do not control what is on the other end, and I am not responsible for it.
The site comes as it is
The site and the games are provided "as is" and "as available", with no warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
In plain terms: I do not promise the site stays up, that a given game runs on your device or browser, that your saves survive, or that anything is free of bugs. This is a hobby project I maintain in my spare time, and it shows sometimes.
Some places do not allow exclusions like these. If that is where you live, this section applies as far as your law allows and no further.
Limits on what I owe you
To the fullest extent the law allows, I am not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost saves, lost profits, or lost time, arising from your use of the site. My total liability for any claim connected to the site is capped at one hundred US dollars.
Nothing in these terms limits liability that cannot be limited by law. That includes death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any mandatory consumer rights you hold in the EU or the UK.
Your side of it
If you break these terms or the law and that lands me in a claim from someone else, you agree to cover the reasonable costs of dealing with it. This clause exists for the rare bad actor, not for you.
Ending access
I can suspend or end your access if you break these terms, abuse the site, or put it at risk. You can stop using the site whenever you like: close the tab, and that is that. To leave the Beta Club, email me and I will remove you.
The sections about ownership, feedback, warranties, liability, and governing law survive after access ends.
Changes to these terms
I will update these terms as the site changes. The "last updated" date at the top moves when I do. Anything material also gets a note in What's New, so you are not expected to re-read this page for sport.
Which law applies
These terms are governed by the laws of the State of Washington, USA, without regard to its conflict of laws rules. Any dispute goes to the state or federal courts located in Washington, and we both agree to that.
If you live in the EU or the UK: you keep the mandatory protections of your local consumer law, and you can bring a claim in your home courts. This section does not take that away from you.
Before anything formal, email me. Most problems are a five minute conversation.
Odds and ends
If a court strikes part of these terms, the rest stays in force. If I do not enforce something right away, I have not given up the right to enforce it later. These terms plus the Privacy Policy are the whole agreement between us about the site. I can transfer them if the site ever changes hands, and you cannot transfer them.
